I would interpret the phrase "unless" in section III (2) f) as follows:
that a poem which embodies the problem itself is assured.
A poem needs to be new because the problem lies in what's behind it, not in the poem itself.
Another example:
In such a case, a head gasket that fails would be covered under warranty because it is "directly and causally related" (it IS the cause) to the work performed and the parts used that constitute the warranty claim.
A bald spot that appears because the hair has been shaved off is not covered by insurance.
And that's exactly how I would argue, and I would want to challenge this section (III (2) f)) in court.
And if it's just making their job more difficult...
Okay, please provide the German text you would like me to translate into English. I will only provide the translation.

Hello Martin,
Thank you for your opinion.
I will definitely insist that they resubmit the warranty claim. If they don't do so, I am considering leaving the car there for now and not paying until further notice. During this time, I would contact Skoda's internal customer service and explain the situation. This is because I have reported the issue multiple times while it was still covered by the factory warranty.
The expert just said back then: 'Don't argue with me, you should hear my Audi!'
There's something else: According to the GPS, the car didn't reach its top speed of 5 km/h with the 195/65-15 tires. I didn't really care about that. But it's my first car that hasn't reached its registered top speed. Maybe it will manage it with the right seal. Then my frustration would be complete. I'll report back.

A BLS that can't handle the pressure?
"My UI, as well as my colleague's Bluemotion BLS Passat, are running smoothly."
The car is registered with a top speed of 187 km/h, and I thought I almost reached 200 km/h on the speedometer.

Hello everyone,
I ended up getting my Octavia after all.
A section of the exhaust manifold, from the exhaust manifold flange to the EGR valve, was replaced.
Unfortunately, I didn't see it.
My car, which I drove for 2 years, has changed drastically.
- It's like going from a 10-year-old Polo diesel to a Passat.
- Converting a Pentium processor with a stock cooler to water cooling.
- It's like someone closed the back window while driving at 190 km/h on the highway...
I love my car the way it is now!!! For two years, I had a loud AND whistling car! The noise level was significantly dependent on the load. I also reported that to the mechanic. That could have alerted him to a problem with the exhaust system.
The workshop foreman at Held and Ströhe in Neu-Ulm has never found that this Octavia didn't deserve its name. Don't they know their own cars?
There are classes in the way now!
Und: er rennt jetzt 200. Und das Ganze sogar leise! Ja, ich finde meinen PD jetzt leise. Jetzt wisst ihr wie laut es war. It was very loud.
Aber das neue Auto ist schon bestellt. Out of frustration.
I usually don't sell cars that are 3 years old!
I had a car that was damaged because of a seal costing only €1.36. The installation cost was €173.
I often hear this whistling sound from passing Tourans, Passats, and Audi A3s and A3 models. It would be great if many people are experiencing this problem and it's not a turbo issue.

If you know the price down to the exact cent, could you please let us know the part number?
Sure, I would also appreciate a scan of the anonymized invoice.
Then you can infer the installation location and look more closely at yourself.

Martin,
The two seals are the following seals:
Exhaust manifold -> Connecting pipe
Exhaust gas recirculation (EGR) cooler connection pipe.
(not the EGR valve!)
Let me see if I can get a picture of her...
EDIT:
Wow, this is really crowded.
BUT:
When looking for a leak, you can also inspect the seals from above. Our seals and their surroundings still look immaculate after 128,000 km. When there's a leak in a diesel engine, it's always accompanied by black soot.
And you definitely had that issue with the seals!

Hello Martin,
Thank you. That's correct; according to the expert, soot traces were visible.
When I asked him to show it to me, he said that the car would have to be brought onto the stage for that. Probably, he just didn't feel like looking at it with me...

Should I show you where the two seals are located?
Then you can look for yourself.

Hello Martin,
Thank you for the offer.
The problem is finally solved. It has been sold. Now, a woman who used to drive a 3-series Golf SDI is driving it and finds it very quiet .
I'm now just waiting for the 2.0 CR TDI Scout that I ordered.
The BLS was finally okay at the end, but I still didn't feel like driving the car anymore...
Let's see what the new one brings.
