In Austria, the daytime lighting requirement has been abolished. It seems they quickly realized that it was ineffective. Consequently, there will likely be no general daytime lighting requirement in Germany either. It's quite ironic when people drive around in the city with their headlights on, but otherwise are 100% energy-conscious, and the same applies to driving in the countryside at a speed limit of 70 km/h.
The situation is likely that, according to EU regulations since the year 20xy, all new vehicles with new designs must be equipped with automatic daytime running lights, regardless of the specific design. Our Smart, manufactured in 2014, did not have this feature because it was an older design. In Germany, the lighting systems of a vehicle must always be operational}.
So, for example, the TFL (Traffic Flow Light) can always be turned on and off via the MMI (Multi Media Interface). Why should one visually indicate to their surroundings that the car is occupied and the ignition is on?
And if the traffic conditions are unclear, I turn on my low beam headlights.
